Terms of Service

1. Purpose

These Terms of Service govern the conditions of use for the online image, video, and motion-copy services provided by hyperreal (the “Service”), as well as the rights, obligations, and responsibilities of members and non-member users (collectively, “Users”).

2. Definitions

• “Service” means the generative AI content tools available on the hyperreal website and related applications.
• “Member” means a User who signs in and uses the Service through an account.
• “Credits” means the in-product usage units required for paid features such as image and video generation.
• “Paid Plan” means a subscription plan offered on a monthly or promotional-period basis.
• “Output” means images, videos, and related results created by a User through the Service.

3. Effectiveness and Changes

These Terms take effect when posted on the Service or otherwise made available to Users. We may revise these Terms to the extent permitted by applicable law and will provide prior notice of the effective date and reason for material changes. If you do not agree to the revised Terms, you may stop using the Service and close your account.

4. Description of the Service

The Service provides preset-based image generation, video generation, Motion Copy, and related features. We may add, change, or discontinue features for operational or technical reasons and will provide reasonable notice of material changes when practicable.

5. Accounts and Eligibility

Some features require sign-in through supported authentication methods such as Google. By continuing with a supported sign-in method, you agree to these Terms of Service and the Privacy Policy. You must provide accurate information and are responsible for safeguarding your account and credentials. Users under 14 may not register or make paid purchases without consent from a legal guardian where required.

6. Paid Services and Billing

Prices, features, and terms for Paid Plans, credit packs, and other paid products are set out on the Pricing page. Payments are processed through designated payment providers, and taxes or fees may apply separately. Promotional pricing applies only for the stated period and conditions.

7. Rights in Inputs and Outputs

You retain rights in original materials you lawfully upload. Rights to use Outputs are granted to you to the extent permitted by applicable law and these Terms and any plan conditions. You must not use the Service in a way that infringes third-party rights, including publicity, copyright, or trademark rights.

8. Prohibited Conduct

• Creating or distributing content that violates law or public policy
• Infringing others’ rights or reputation
• Automation, abuse, or other misuse that disrupts normal operation of the Service
• Unauthorized trading or sharing of accounts, payments, or credits
• Bypassing security controls or compromising systems

9. Service Interruptions

Service may be temporarily unavailable due to force majeure, system failures, partner outages, or scheduled or emergency maintenance. We will make reasonable efforts to provide notice before or after such interruptions.

10. Limitation of Liability

Because of the nature of generative AI, we do not warrant that Outputs will be accurate, complete, or fit for a particular purpose. To the extent permitted by law, our liability related to a claim is limited to the amounts you paid for the Service in the three months preceding the claim, except in cases of willful misconduct or gross negligence.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea. The parties will attempt in good faith to resolve disputes arising from use of the Service. If unresolved, claims may be brought in a court of competent jurisdiction under applicable civil procedure rules.
